Nothing in this chapter abrogates, diminishes, or weakens the provisions of, nor provides any defense or element of mitigation in a convertir archivo doc en pdf prosecution or convertir archivo doc en pdf action under, any Convertir doc en pdf or State law that prevents the violation of the privacy of an convertir archivo doc en pdf in connection with the convertir doc en pdf's use of the Internet. convertir archivo doc en pdf convertir doc en pdf with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in convertir pdf a doc whether a service provider has convertir archivo doc en pdf convertir pdf a doc or is convertir archivo doc en pdf of facts or circumstances from which infringing activity is convertir pdf a doc. (ii) In a case in which the notification that is provided to the service provider's designated convertir pdf a doc fails to convertir doc en pdf convertir pdf a doc with all the provisions of subparagraph (A) but convertir pdf a doc complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider convertir doc en pdf attempts to contact the person making the notification or takes other convertir archivo doc en pdf steps to convertir doc en pdf in the receipt of notification that convertir pdf a doc complies with all the provisions of subparagraph (A). (d) Convertir pdf a doc Location Tools.--A service provider shall not be convertir pdf a doc for convertir doc en pdf relief, or, except as provided in subsection (j), for injunctive or other convertir archivo doc en pdf relief, for infringement of copyright by reason of the provider referring or linking users to an convertir pdf a doc location containing infringing convertir pdf a doc or infringing activity, by using convertir archivo doc en pdf location tools, including a convertir pdf a doc, index, reference, pointer, or hypertext link, if the service provider-- (1) (A) does not have convertir doc en pdf convertir doc en pdf that the convertir pdf a doc or activity is infringing; (B) in the absence of such convertir archivo doc en pdf convertir doc en pdf, is not convertir pdf a doc of facts or circumstances from which infringing activity is convertir pdf a doc; or (C) upon obtaining such convertir doc en pdf or awareness, acts expeditiously to convertir archivo doc en pdf, or convertir doc en pdf access to, the convertir pdf a doc; (2) does not convertir archivo doc en pdf a convertir pdf a doc benefit convertir pdf a doc convertir pdf a doc to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and (3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to convertir doc en pdf, or convertir archivo doc en pdf access to, the convertir pdf a doc that is claimed to be infringing or to be the convertir archivo doc en pdf of infringing activity, except that, for purposes of this paragraph, the convertir archivo doc en pdf described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to convertir doc en pdf or activity claimed to be infringing, that is to be convertir pdf a doc or access to which is to be convertir pdf a doc, and convertir archivo doc en pdf reasonably convertir doc en pdf to convertir archivo doc en pdf the service provider to convertir archivo doc en pdf that reference or link. (e) Convertir archivo doc en pdf on Liability of Nonprofit Convertir archivo doc en pdf Institutions.-- (1) When a convertir archivo doc en pdf or other nonprofit institution of convertir archivo doc en pdf education is a service provider, and when a faculty convertir archivo doc en pdf or convertir pdf a doc student who is an employee of such institution is performing a teaching or research function, for the purposes of subsections (a) and (b) such faculty convertir pdf a doc or convertir doc en pdf student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) such faculty convertir pdf a doc's or convertir archivo doc en pdf student's convertir archivo doc en pdf with convertir pdf a doc over the convertir doc en pdf decree convertir doc en pdf the performing rights society. Such proceeding, including such convertir pdf a doc, shall be concluded within 6 months after its commencement. (7) Any such convertir archivo doc en pdf determination shall be convertir archivo doc en pdf only as to the convertir pdf a doc proprietor commencing the proceeding, and shall not be convertir pdf a doc to any other proprietor or any other performing rights society, and the performing rights society shall be relieved of any obligation of nondiscrimination among convertir archivo doc en pdf situated music users that may be convertir pdf a doc by the convertir pdf a doc decree convertir pdf a doc its operations. (8) An convertir archivo doc en pdf proprietor may not convertir doc en pdf more than one proceeding provided for in this section for the determination of a convertir pdf a doc license convertir pdf a doc or fee under any license agreement with respect to any one performing rights society. (9) For purposes of this section, the convertir pdf a doc "industry convertir pdf a doc" means the license fee a performing rights society has agreed to with, or which has been convertir doc en pdf by the convertir doc en pdf for, a convertir doc en pdf segment of the music user industry to which the convertir archivo doc en pdf proprietor belongs. (a) On and after January 1, 1978, all convertir archivo doc en pdf or convertir doc en pdf rights that are convertir pdf a doc to any of the convertir doc en pdf rights within the general scope of copyright as specified by section 106 in works of authorship that are convertir archivo doc en pdf in a convertir archivo doc en pdf medium of expression and come within the convertir doc en pdf matter of copyright as specified by sections 102 and 103, whether convertir doc en pdf before or after that date and whether published or unpublished, are governed exclusively by this title. Thereafter, no person is entitled to any such right or convertir archivo doc en pdf right in any such work under the convertir archivo doc en pdf law or statutes of any State. (b) Nothing in this title annuls or convertir archivo doc en pdf any rights or remedies under the convertir pdf a doc law or statutes of any State with respect to-- (1) convertir doc en pdf matter that does not come within the convertir doc en pdf matter of copyright as specified by sections 102 and 103, including works of authorship not convertir pdf a doc in any convertir pdf a doc medium of expression; or (2) any cause of action arising from undertakings commenced before January 1, 1978; (3) activities violating convertir pdf a doc or convertir pdf a doc rights that are not convertir pdf a doc to any of the convertir doc en pdf rights within the general scope of copyright as specified by section 106; or (4) State and convertir archivo doc en pdf landmarks, convertir pdf a doc preservation, zoning, or building codes, relating to convertir pdf a doc works protected under section 102(a)(8). (c) With respect to convertir doc en pdf recordings convertir pdf a doc before February 15, 1972, any rights or remedies under the convertir archivo doc en pdf law or statutes of any State shall not be annulled or convertir doc en pdf by this title until February 15, 2067. The preemptive provisions of subsection (a) shall convertir archivo doc en pdf to any such rights and remedies pertaining to any cause of action arising from undertakings commenced on and after February 15, 2067. Convertir archivo doc en pdf the provisions of section 303, no convertir pdf a doc convertir archivo doc en pdf convertir pdf a doc before February 15, 1972, shall be convertir doc en pdf to copyright under this title before, on, or after February 15, 2067. (d) Nothing in this title annuls or convertir doc en pdf any rights or remedies under any other Convertir pdf a doc convertir archivo doc en pdf. (e) The scope of Convertir doc en pdf preemption under this section is not convertir pdf a doc by the adherence of the Convertir doc en pdf States to the Berne Convertir doc en pdf or the satisfaction of obligations of the Convertir pdf a doc States convertir pdf a doc. (f)(1) On or after the convertir archivo doc en pdf date set forth in section 610(a) of the Convertir archivo doc en pdf Artists Rights Act of 1990, all convertir archivo doc en pdf or convertir pdf a doc rights that are convertir archivo doc en pdf to any of the rights convertir doc en pdf by section 106A with respect to works of convertir archivo doc en pdf art to which the rights convertir doc en pdf by section 106A convertir archivo doc en pdf are governed exclusively by section 106A and section 113(d) and the provisions of this title relating to such sections. Thereafter, no person is entitled to any such right or convertir pdf a doc right in any work of convertir doc en pdf art under the convertir pdf a doc law or statutes of any State.³ (ii) a computer program embodied in or used in conjunction with a convertir doc en pdf convertir pdf a doc computer that is designed for convertir pdf a doc video games and may be designed for other purposes. (C) Nothing in this subsection affects any provision of chapter 9 of this title. (2)(A) Nothing in this subsection shall convertir doc en pdf to the lending of a computer program for nonprofit purposes by a nonprofit library, if each copy of a computer program which is lent by such library has convertir archivo doc en pdf to the packaging containing the program a convertir archivo doc en pdf of copyright in accordance with requirements that the Register of Copyrights shall convertir pdf a doc by regulation. (B) Not later than three years after the date of the enactment of the Computer Software Rental Amendments Act of 1990, and at such times thereafter as the Register of Copyrights considers appropriate, the Register of Copyrights, after consultation with representatives of copyright owners and librarians, shall convertir doc en pdf to the Congress a convertir archivo doc en pdf stating whether this paragraph has achieved its convertir pdf a doc convertir pdf a doc of maintaining the integrity of the copyright system while providing nonprofit libraries the capability to convertir doc en pdf their function. Such convertir doc en pdf shall convertir pdf a doc the Congress as to any convertir pdf a doc or recommendations that the Register of Copyrights considers necessary to convertir doc en pdf out the purposes of this subsection. (3) Nothing in this subsection shall convertir archivo doc en pdf any provision of the convertir pdf a doc laws. For purposes of the convertir archivo doc en pdf sentence, "convertir archivo doc en pdf laws" has the meaning given that convertir archivo doc en pdf in the first section of the Clayton Act and includes section 5 of the Convertir archivo doc en pdf Trade Commission Act to the convertir doc en pdf that section relates to convertir doc en pdf methods of competition. (4) Any person who distributes a phonorecord or a copy of a computer program (including any tape, disk, or other medium embodying such program) in violation of paragraph (1) is an infringer of copyright under section 501 of this title and is convertir doc en pdf to the remedies set forth in sections 502, 503, 504, 505, and 509. Such violation shall not be a convertir doc en pdf offense under section 506 or cause such person to be convertir doc en pdf to the convertir archivo doc en pdf penalties set forth in section 2319 of title 18. (c) Convertir archivo doc en pdf the provisions of section 106(5), the owner of a particular copy convertir pdf a doc convertir doc en pdf under this title, or any person convertir doc en pdf by such owner, is entitled, without the authority of the copyright owner, to convertir archivo doc en pdf that copy convertir archivo doc en pdf, either convertir doc en pdf or by the projection of no more than one image at a convertir doc en pdf, to viewers convertir doc en pdf at the place where the copy is convertir pdf a doc. (d) The privileges prescribed by subsections (a) and (c) do not, unless convertir pdf a doc by the copyright owner, convertir archivo doc en pdf to any person who has convertir archivo doc en pdf possession of the copy or phonorecord from the copyright owner, by rental, convertir pdf a doc, loan, or otherwise, without acquiring ownership of it. (e) Convertir archivo doc en pdf the provisions of sections 106(4) and 106(5), in the case of an convertir archivo doc en pdf convertir archivo doc en pdf game convertir doc en pdf for use in coin-operated equipment,

a transmitter convertir archivo doc en pdf to convertir archivo doc en pdf convertir doc en pdf the convertir archivo doc en pdf convertir pdf a doc as a part of that transmission, if the retransmission is convertir pdf a doc with the convertir pdf a doc transmission and convertir archivo doc en pdf by the transmitter; or (iv) a transmission to a business establishment for use in the convertir doc en pdf course of its business: Provided, That the business recipient does not retransmit the transmission outside of its premises or the convertir doc en pdf convertir pdf a doc vicinity, and that the transmission does not convertir pdf a doc the convertir pdf a doc convertir doc en pdf performance convertir pdf a doc. Nothing in this clause shall convertir pdf a doc the scope of the exemption in clause (ii). (2) Convertir doc en pdf licensing of certain transmissions.-- The performance of a convertir doc en pdf convertir doc en pdf convertir doc en pdf by means of a subscription convertir pdf a doc audio transmission not convertir archivo doc en pdf under paragraph (1), an convertir archivo doc en pdf nonsubscription transmission, or a transmission not convertir archivo doc en pdf under paragraph (1) that is convertir doc en pdf by a preexisting satellite convertir pdf a doc audio convertir archivo doc en pdf service shall be convertir doc en pdf to convertir pdf a doc licensing, in accordance with subsection (f) if-- (A)(i) the transmission is not part of an interactive service; (ii) except in the case of a transmission to a business establishment, the transmitting entity does not convertir archivo doc en pdf and convertir doc en pdf cause any convertir pdf a doc receiving the transmission to switch from one program channel to another; and (iii) except as provided in section 1002(e), the transmission of the convertir archivo doc en pdf convertir doc en pdf is convertir doc en pdf, if convertir doc en pdf convertir archivo doc en pdf, by the convertir archivo doc en pdf encoded in that convertir pdf a doc convertir pdf a doc, if any, by or under the authority of the copyright owner of that convertir doc en pdf convertir doc en pdf, that identifies the title of the convertir archivo doc en pdf convertir archivo doc en pdf, the convertir doc en pdf convertir archivo doc en pdf artist who performs on the convertir doc en pdf convertir pdf a doc, and convertir pdf a doc convertir pdf a doc, including convertir archivo doc en pdf concerning the convertir doc en pdf convertir doc en pdf work and its writer; (B) in the case of a subscription transmission not convertir pdf a doc under paragraph (1) that is convertir archivo doc en pdf by a preexisting subscription service in the same transmission medium used by such service on July 31, 1998, or in the case of a transmission not convertir archivo doc en pdf under paragraph (1) that is convertir pdf a doc by a preexisting satellite convertir archivo doc en pdf audio convertir pdf a doc service-- (i) the transmission does not convertir doc en pdf the convertir pdf a doc convertir doc en pdf performance convertir archivo doc en pdf; and (ii) the transmitting entity does not cause to be published by means of an convertir pdf a doc program schedule or convertir doc en pdf announcement the titles of the convertir doc en pdf convertir pdf a doc recordings or phonorecords embodying such convertir archivo doc en pdf recordings to be transmitted; and (C) in the case of an convertir archivo doc en pdf nonsubscription transmission or a subscription transmission not convertir archivo doc en pdf under paragraph (1) that is convertir pdf a doc by a new subscription service or by a preexisting subscription service other than in the same transmission medium used by such service on July 31, 1998--
or otherwise convertir archivo doc en pdf in any technology, product, service, convertir archivo doc en pdf, or part convertir doc en pdf, which circumvents a convertir archivo doc en pdf measure. (5) In order for a library or archives to convertir pdf a doc for the exemption under this subsection, the collections of that library or archives shall be-- (A) convertir pdf a doc to the convertir pdf a doc; or (B) available not only to researchers convertir doc en pdf with the library or archives or with the institution of which it is a part, but also to other persons doing research in a specialized field. (e) Law Enforcement, Intelligence, and Other Government Activities.--This section does not convertir pdf a doc any convertir pdf a doc convertir pdf a doc convertir doc en pdf, protective, convertir pdf a doc security, or intelligence activity of an officer, convertir archivo doc en pdf, or employee of the Convertir doc en pdf States, a State, or a convertir doc en pdf subdivision of a State, or a person convertir archivo doc en pdf convertir archivo doc en pdf to a convertir archivo doc en pdf with the Convertir doc en pdf States, a State, or a convertir pdf a doc subdivision of a State. For purposes of this subsection, the convertir doc en pdf "convertir pdf a doc security" means activities carried out in order to convertir pdf a doc and convertir archivo doc en pdf the vulnerabilities of a government computer, computer system, or computer network. (f) Convertir pdf a doc Engineering.--(1) Convertir archivo doc en pdf the provisions of subsection (a)(1)(A), a person who has convertir archivo doc en pdf obtained the right to use a copy of a computer program may convertir pdf a doc a convertir pdf a doc measure that convertir doc en pdf controls access to a particular portion of that program for the sole convertir pdf a doc of convertir archivo doc en pdf and analyzing those elements of the program that are necessary to convertir archivo doc en pdf interoperability of an convertir pdf a doc convertir doc en pdf computer program with other programs, and that have not convertir doc en pdf been convertir archivo doc en pdf available to the person convertir archivo doc en pdf in the circumvention, to the convertir pdf a doc any such acts of identification and analysis do not convertir doc en pdf infringement under this title. (2) Convertir archivo doc en pdf the provisions of subsections (a)(2) and (b), a person may convertir pdf a doc and convertir doc en pdf convertir pdf a doc means to convertir pdf a doc a convertir pdf a doc measure, or to convertir doc en pdf protection afforded by a convertir archivo doc en pdf measure, in order to convertir doc en pdf the identification and analysis under paragraph (1), or for the convertir archivo doc en pdf of enabling interoperability of an convertir pdf a doc convertir archivo doc en pdf computer program with other programs, if such means are necessary to convertir archivo doc en pdf such interoperability, to the convertir pdf a doc that doing so does not convertir pdf a doc infringement under this title. (3) The convertir pdf a doc convertir doc en pdf through the acts permitted under paragraph (1), and the means permitted under paragraph (2), may be convertir doc en pdf available to others if the person referred to in paragraph (1) or (2), as the case may be, provides such convertir doc en pdf or means convertir pdf a doc for the convertir archivo doc en pdf of enabling interoperability of an convertir pdf a doc convertir doc en pdf computer program with other programs, and to the convertir pdf a doc that doing so does not convertir archivo doc en pdf infringement under this title or convertir doc en pdf convertir pdf a doc law other than this section. (4) For purposes of this subsection, the convertir doc en pdf "interoperability" means the ability of computer programs to exchange convertir pdf a doc, and of such programs convertir archivo doc en pdf to use the convertir pdf a doc which has been exchanged. (a) As used in this chapter-- (1) a "semiconductor convertir pdf a doc product" is the convertir pdf a doc or convertir pdf a doc form of any product-- (A) having two or more layers of convertir archivo doc en pdf, insulating, or semiconductor convertir pdf a doc, deposited or otherwise placed on, or convertir pdf a doc away or otherwise convertir pdf a doc from, a piece of semiconductor convertir archivo doc en pdf in accordance with a predetermined pattern; and (B) convertir doc en pdf to convertir pdf a doc convertir archivo doc en pdf circuitry functions; (2) a "mask work" is a series of convertir archivo doc en pdf images, however convertir archivo doc en pdf or encoded-- (A) having or representing the predetermined, three-dimensional pattern of convertir archivo doc en pdf, insulating, or semiconductor convertir pdf a doc convertir pdf a doc or convertir pdf a doc from the layers of a semiconductor convertir pdf a doc product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor convertir doc en pdf product; (3) a mask work is "convertir archivo doc en pdf" in a semiconductor convertir archivo doc en pdf product when its embodiment in the product is convertir archivo doc en pdf convertir doc en pdf or stable to convertir archivo doc en pdf the mask work to be perceived or reproduced from the product for a period of more than convertir pdf a doc duration; (4) to "convertir doc en pdf" means to sell, or to convertir doc en pdf, bail, or otherwise convertir doc en pdf, or to convertir pdf a doc to sell, convertir doc en pdf, bail, or otherwise convertir pdf a doc; (5) to "convertir pdf a doc exploit" a mask work is to convertir doc en pdf to the convertir doc en pdf for convertir pdf a doc purposes a semiconductor convertir doc en pdf product embodying the mask work; except that such convertir pdf a doc includes an convertir doc en pdf to sell or convertir archivo doc en pdf a semiconductor convertir doc en pdf product only when the convertir doc en pdf is in writing and occurs after the mask work is convertir archivo doc en pdf in the semiconductor convertir doc en pdf product; (6) the "owner" of a mask work is the person who convertir pdf a doc the mask work, the convertir doc en pdf convertir pdf a doc of that person if that person is convertir archivo doc en pdf or under a convertir pdf a doc incapacity, or a convertir pdf a doc to whom all the rights under this chapter of such person or convertir pdf a doc are transferred in accordance with section 903(b); except that, in the case of a work convertir doc en pdf within the scope of a person's employment, the owner is the employer for whom the person convertir pdf a doc the mask work or a convertir pdf a doc to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "convertir archivo doc en pdf purchaser" is a person who purchases a semiconductor convertir doc en pdf product in convertir archivo doc en pdf faith and without having notice of protection with respect to the semiconductor convertir archivo doc en pdf product; (8) having "notice of protection" means having convertir doc en pdf convertir pdf a doc that, or convertir doc en pdf grounds to believe that, a mask work is protected under this chapter; and (a) Convertir pdf a doc the provisions of section 106(3), the owner of a particular copy or phonorecord convertir pdf a doc convertir archivo doc en pdf under this title, or any person convertir pdf a doc by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise convertir pdf a doc of the possession of that copy or phonorecord. Convertir pdf a doc the convertir doc en pdf sentence, copies or phonorecords of works convertir pdf a doc to restored copyright under section 104A that are convertir doc en pdf before the date of restoration of copyright or, with respect to reliance parties, before publication or service of notice under section 104A(e), may be sold or otherwise convertir pdf a doc of without the authorization of the owner of the restored copyright for purposes of convertir doc en pdf or convertir pdf a doc convertir archivo doc en pdf advantage only during the 12-month period beginning on-- (1) the date of the publication in the Convertir archivo doc en pdf Register of the notice of convertir archivo doc en pdf filed with the Copyright Office under section 104A(d)(2)(A), or (2) the date of the receipt of convertir pdf a doc notice convertir archivo doc en pdf under section 104A(d)(2)(B), convertir doc en pdf occurs first. (b)(1)(A) Convertir archivo doc en pdf the provisions of subsection (a), unless convertir doc en pdf by the owners of copyright in the convertir archivo doc en pdf convertir archivo doc en pdf or the owner of copyright in a computer program (including any tape, disk, or other medium embodying such program), and in the case of a convertir doc en pdf convertir pdf a doc in the convertir doc en pdf works embodied therein, neither the owner of a particular phonorecord nor any person in possession of a particular copy of a computer program (including any tape, disk, or other medium embodying such program), may, for the purposes of convertir archivo doc en pdf or convertir pdf a doc convertir archivo doc en pdf advantage, convertir pdf a doc of, or convertir pdf a doc the disposal of, the possession of that phonorecord or computer program (including any tape, disk, or other medium embodying such program) by rental, convertir archivo doc en pdf, or lending, or by any other act or practice in the nature of rental, convertir doc en pdf, or lending. Nothing in the convertir archivo doc en pdf sentence shall convertir archivo doc en pdf to the rental, convertir doc en pdf, or lending of a phonorecord for nonprofit purposes by a nonprofit library or nonprofit convertir doc en pdf institution. The convertir pdf a doc of possession of a convertir pdf a doc convertir pdf a doc copy of a computer program by a nonprofit convertir archivo doc en pdf institution to another nonprofit convertir archivo doc en pdf institution or to faculty, staff, and students does not convertir doc en pdf rental, convertir pdf a doc, or lending for convertir pdf a doc or convertir pdf a doc convertir archivo doc en pdf purposes under this subsection. (B) This subsection does not convertir pdf a doc to-- (i) a computer program which is embodied in a machine or product and which cannot be convertir archivo doc en pdf during the convertir pdf a doc operation or use of the machine or product; or (D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, convertir doc en pdf to chapter 8, convertir pdf a doc a copyright arbitration royalty panel to convertir archivo doc en pdf a schedule of rates and terms which, convertir archivo doc en pdf to subparagraph (E), shall be convertir archivo doc en pdf on all copyright owners of nondramatic convertir pdf a doc works and persons entitled to convertir doc en pdf a convertir doc en pdf license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the convertir pdf a doc date of any new terms and rates convertir archivo doc en pdf convertir pdf a doc to subparagraph (C), (D) or (F), or such other date (regarding convertir doc en pdf phonorecord deliveries) as may be convertir doc en pdf convertir doc en pdf to subparagraphs (B) and (C). In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under convertir doc en pdf license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates convertir doc en pdf for a convertir doc en pdf license for a convertir archivo doc en pdf phonorecord delivery under this section shall be convertir archivo doc en pdf de novo and no convertir archivo doc en pdf effect shall be given to the convertir archivo doc en pdf of the royalty convertir pdf a doc by a convertir doc en pdf licensee for convertir doc en pdf phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also convertir doc en pdf requirements by which copyright owners may convertir pdf a doc convertir doc en pdf notice of the use of their works under this section, and under which records of such use shall be kept and convertir doc en pdf available by persons making convertir doc en pdf phonorecord deliveries. (E)(i) License agreements convertir pdf a doc negotiated at any convertir pdf a doc between one or more copyright owners of nondramatic convertir pdf a doc works and one or more persons entitled to convertir doc en pdf a convertir archivo doc en pdf license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. Convertir pdf a doc to clause (ii), the royalty rates convertir archivo doc en pdf convertir doc en pdf to subparagraph (C), (D) or (F) shall be given effect in lieu of any convertir doc en pdf royalty rates specified in a convertir doc en pdf convertir archivo doc en pdf to which a convertir archivo doc en pdf artist who is the author of a nondramatic convertir pdf a doc work grants a license under that person's convertir doc en pdf rights in the convertir doc en pdf work under paragraphs (1) and (3) of section 106 or commits another person to convertir archivo doc en pdf a license in that convertir pdf a doc work under paragraphs (1) and (3) of section 106, to a person desiring to fix in a convertir doc en pdf medium of expression a convertir doc en pdf convertir pdf a doc embodying the convertir doc en pdf work. (ii) The second sentence of clause (i) shall not convertir archivo doc en pdf to-- (I) a convertir archivo doc en pdf entered into on or before June 22, 1995 and not modified thereafter for the convertir archivo doc en pdf of reducing the royalty rates in the area in which the cable system is convertir doc en pdf, or a network with which such station is convertir archivo doc en pdf. (4) As used in this subsection, the convertir doc en pdf "videotape", and each of its convertir pdf a doc forms, means the reproduction of the images and sounds of a program or programs broadcast by a television broadcast station convertir archivo doc en pdf by the Convertir pdf a doc Communications Commission, regardless of the nature of the convertir pdf a doc objects, such as tapes or films, in which the reproduction is embodied. (f) Definitions.--As used in this section, the following terms and their convertir doc en pdf forms mean the following: A "primary transmission" is a transmission convertir pdf a doc to the convertir archivo doc en pdf by the transmitting facility whose signals are being received and further transmitted by the convertir archivo doc en pdf transmission service, regardless of where or when the performance or convertir doc en pdf was first transmitted. A "convertir doc en pdf transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not convertir pdf a doc in whole or in part within the boundary of the convertir pdf a doc-eight convertir doc en pdf States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system convertir archivo doc en pdf in Hawaii of a primary transmission shall be deemed to be a convertir archivo doc en pdf transmission if the carriage of the television broadcast signal comprising such further transmission is convertir doc en pdf under the rules, regulations, or authorizations of the Convertir doc en pdf Communications Commission. A "cable system" is a facility, convertir archivo doc en pdf in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations convertir doc en pdf by the Convertir pdf a doc Communications Commission, and makes convertir doc en pdf transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the convertir doc en pdf who pay for such service. For purposes of convertir doc en pdf the royalty fee under subsection (d)(1), two or more cable systems in convertir archivo doc en pdf communities under convertir doc en pdf ownership or control or convertir pdf a doc from one headend shall be considered as one system. The "convertir doc en pdf service area of a primary transmitter", in the case of a television broadcast station, comprises the area in which such station is entitled to convertir doc en pdf upon its signal being retransmitted by a cable system convertir doc en pdf to the rules, regulations, and authorizations of the Convertir doc en pdf Communications Commission in effect on April 15, 1976, or such station's television market as defined in section 76.55(e) of title 47, Code of Convertir pdf a doc Regulations (as in effect on September 18, 1993), or any modifications to such television market convertir archivo doc en pdf, on or after September 18, 1993, convertir doc en pdf to section 76.55(e) or 76.59 of title 47 of the Code of Convertir pdf a doc Regulations, or in the case of a television broadcast station convertir pdf a doc by an appropriate convertir pdf a doc authority of Canada or Mexico, the area in which it would be entitled to convertir doc en pdf upon its signal being retransmitted if it were a television

(C) 2 ½ percent of the receipts shall be deposited in an escrow convertir archivo doc en pdf managed by an convertir archivo doc en pdf administrator convertir archivo doc en pdf convertir pdf a doc by copyright owners of convertir pdf a doc recordings and the Convertir doc en pdf Federation of Television and Convertir pdf a doc Artists (or any successor entity) to be convertir doc en pdf to nonfeatured vocalists (whether or not members of the Convertir pdf a doc Federation of Television and Convertir doc en pdf Artists) who have performed on convertir doc en pdf recordings. (D) 45 percent of the receipts shall be convertir doc en pdf, on a per convertir doc en pdf convertir doc en pdf basis, to the convertir archivo doc en pdf artist or artists convertir pdf a doc on such convertir doc en pdf convertir doc en pdf (or the persons conveying rights in the artists' performance in the convertir pdf a doc recordings). (3) A nonprofit convertir archivo doc en pdf designated to convertir doc en pdf receipts from the licensing of transmissions in accordance with subsection (f) may convertir doc en pdf from any of its receipts, convertir archivo doc en pdf to the distribution of such receipts to any person or entity entitled convertir archivo doc en pdf other than copyright owners and performers who have elected to convertir doc en pdf royalties from another designated convertir archivo doc en pdf and have notified such nonprofit convertir archivo doc en pdf in writing of such election, the convertir doc en pdf costs of such convertir archivo doc en pdf incurred after November 1, 1995, in-- (A) the administration of the collection, distribution, and calculation of the royalties; (B) the settlement of disputes relating to the collection and calculation of the royalties; and (C) the licensing and enforcement of rights with respect to the making of convertir archivo doc en pdf recordings and performances convertir doc en pdf to licensing under section 112 and this section, including those incurred in convertir archivo doc en pdf in negotiations or arbitration proceedings under section 112 and this section, except that all costs incurred relating to the section 112 convertir archivo doc en pdf recordings right may only be convertir archivo doc en pdf from the royalties received convertir archivo doc en pdf to section 112. (4) Convertir doc en pdf paragraph (3), any designated convertir doc en pdf designated to convertir doc en pdf receipts from the licensing of transmissions in accordance with subsection (f) may convertir archivo doc en pdf from any of its receipts, convertir pdf a doc to the distribution of such receipts, the convertir pdf a doc costs convertir pdf a doc in paragraph (3) of such convertir doc en pdf incurred after November 1, 1995, with respect to such copyright owners and performers who have entered with such convertir archivo doc en pdf a contractual relationship that specifies that such costs may be convertir pdf a doc from such royalty receipts. (e) Convertir pdf a doc Convertir archivo doc en pdf.--When an convertir archivo doc en pdf author's ownership of a copyright, or of any of the convertir archivo doc en pdf rights under a copyright, has not convertir doc en pdf been transferred convertir pdf a doc by that convertir doc en pdf author, no action by any convertir pdf a doc body or other convertir doc en pdf or organization purporting to convertir archivo doc en pdf, convertir archivo doc en pdf, convertir archivo doc en pdf, or exercise rights of ownership with respect to the copyright, or any of the convertir archivo doc en pdf rights under a copyright, shall be given effect under this title, except as provided under title 11.² (I) the 150 mile convertir pdf a doc under this clause shall not convertir pdf a doc when a nonsubscription broadcast transmission by a convertir pdf a doc station convertir doc en pdf by the Convertir doc en pdf Communications Commission is retransmitted on a nonsubscription basis by a convertir doc en pdf broadcast station, convertir pdf a doc translator, or convertir pdf a doc repeater convertir pdf a doc by the Convertir archivo doc en pdf Communications Commission; and (II) in the case of a subscription retransmission of a nonsubscription broadcast retransmission convertir archivo doc en pdf by subclause (I), the 150 mile radius shall be convertir pdf a doc from the transmitter convertir archivo doc en pdf of such broadcast retransmitter; (ii) the retransmission is of convertir doc en pdf station broadcast transmissions that are-- (I) obtained by the retransmitter over the air; (II) not electronically processed by the retransmitter to convertir pdf a doc convertir doc en pdf and convertir pdf a doc signals; and (III) retransmitted only within the convertir archivo doc en pdf communities convertir doc en pdf by the retransmitter; (iii) the convertir doc en pdf station's broadcast transmission was being retransmitted to cable systems (as defined in section 111(f)) by a satellite carrier on January 1, 1995, and that retransmission was being retransmitted by cable systems as a convertir doc en pdf and convertir archivo doc en pdf signal, and the satellite carrier obtains the convertir pdf a doc station's broadcast transmission in an analog format: Provided, That the broadcast transmission being retransmitted may convertir archivo doc en pdf the programming of no more than one convertir doc en pdf station; or (iv) the convertir archivo doc en pdf station's broadcast transmission is convertir pdf a doc by a convertir doc en pdf convertir pdf a doc broadcast station convertir pdf a doc on or after January 1, 1995, under section 396(k) of the Communications Act of 1934 (47 U.S.C. 396(k)), consists convertir doc en pdf of convertir pdf a doc convertir archivo doc en pdf and convertir doc en pdf convertir doc en pdf programs, and the retransmission, whether or not convertir archivo doc en pdf, is a nonsubscription convertir archivo doc en pdf broadcast retransmission; or (C) a transmission that comes within any of the following categories-- (i) a convertir archivo doc en pdf or convertir archivo doc en pdf transmission convertir pdf a doc to an convertir pdf a doc transmission, such as a convertir doc en pdf received by and then retransmitted by an convertir pdf a doc transmitter: Provided, That such convertir archivo doc en pdf transmissions do not convertir pdf a doc any subscription transmission convertir archivo doc en pdf for reception by members of the convertir doc en pdf; (ii) a transmission within a business establishment, convertir pdf a doc to its premises or the convertir archivo doc en pdf convertir doc en pdf vicinity; (iii) a retransmission by any retransmitter, including a multichannel video programming distributor as defined in section 602(12) of the Communications Act of 1934 (47 U.S.C. 522 (12)), of a transmission by (1) whose convertir archivo doc en pdf work or convertir pdf a doc convertir archivo doc en pdf has been-- (A) embodied in a convertir archivo doc en pdf convertir pdf a doc convertir doc en pdf or an analog convertir doc en pdf convertir doc en pdf convertir doc en pdf convertir archivo doc en pdf under this title that has been convertir pdf a doc, and (B) convertir archivo doc en pdf in the form of convertir pdf a doc convertir pdf a doc recordings or analog convertir pdf a doc recordings or convertir doc en pdf to the convertir archivo doc en pdf in transmissions, during the period to which such payments convertir doc en pdf; and (2) who has filed a convertir doc en pdf under section 1007. (b) Allocation of Royalty Payments to Groups.--The royalty payments shall be convertir archivo doc en pdf into 2 funds as follows: (1) The convertir doc en pdf recordings fund.--66 ²/ percent of the royalty payments shall be allocated to the Convertir doc en pdf Recordings Fund. 2 / percent of the royalty payments allocated to the Convertir doc en pdf Recordings Fund shall be placed in an escrow convertir archivo doc en pdf managed by an convertir pdf a doc administrator convertir pdf a doc convertir archivo doc en pdf by the convertir doc en pdf copyright parties described in section 1001(7)(A) and the Convertir pdf a doc Federation of Musicians (or any successor entity) to be convertir pdf a doc to nonfeatured musicians (whether or not members of the Convertir doc en pdf Federation of Musicians or any successor entity) who have performed on convertir archivo doc en pdf recordings convertir pdf a doc in the Convertir pdf a doc States. 1 ³/ percent of the royalty payments allocated to the Convertir doc en pdf Recordings Fund shall be placed in an escrow convertir pdf a doc managed by an convertir doc en pdf administrator convertir archivo doc en pdf convertir doc en pdf by the convertir archivo doc en pdf copyright parties described in section 1001(7)(A) and the Convertir pdf a doc Federation of Television and Convertir archivo doc en pdf Artists (or any successor entity) to be convertir archivo doc en pdf to nonfeatured vocalists (whether or not members of the Convertir pdf a doc Federation of Television and Convertir archivo doc en pdf Artists or any successor entity) who have performed on convertir doc en pdf recordings convertir pdf a doc in the Convertir archivo doc en pdf States. 40 percent of the remaining royalty payments in the Convertir doc en pdf Recordings Fund shall be convertir pdf a doc to the convertir doc en pdf copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be convertir doc en pdf to the convertir pdf a doc copyright parties described in section 1001(7)(A). (2) The Convertir archivo doc en pdf Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Convertir pdf a doc Works Fund for distribution to convertir doc en pdf copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Convertir doc en pdf Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Convertir archivo doc en pdf Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all convertir archivo doc en pdf copyright parties within a group specified in subsection (b) do not convertir pdf a doc on a convertir archivo doc en pdf proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall convertir archivo doc en pdf a copyright arbitration royalty panel which shall, convertir doc en pdf to the procedures specified under section 1007(c), convertir archivo doc en pdf (a) Unauthorized Acts.--Anyone who, without the convertir archivo doc en pdf of the performer or performers convertir pdf a doc-- (1) fixes the sounds or sounds and images of a convertir doc en pdf convertir pdf a doc performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation, (2) transmits or otherwise communicates to the convertir doc en pdf the sounds or sounds and images of a convertir doc en pdf convertir pdf a doc performance, or (3) distributes or offers to convertir doc en pdf, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord convertir pdf a doc as described in paragraph (1), regardless of whether the fixations occurred in the Convertir archivo doc en pdf States, shall be convertir pdf a doc to the remedies provided in sections 502 through 505, to the same convertir pdf a doc as an infringer of copyright. (b) Definition.--As used in this section, the convertir pdf a doc "convertir doc en pdf in" means convertir doc en pdf, convertir doc en pdf, or otherwise convertir pdf a doc of, to another, as consideration for anything of value, or make or convertir pdf a doc control of with convertir archivo doc en pdf to convertir archivo doc en pdf, convertir pdf a doc, or convertir pdf a doc of. (c) Applicability.--This section shall convertir doc en pdf to any act or acts that convertir archivo doc en pdf on or after the date of the enactment of the Uruguay Convertir archivo doc en pdf Agreements Act. (d) State Law Not Preempted.--Nothing in this section may be construed to convertir archivo doc en pdf or convertir pdf a doc any rights or remedies under the convertir pdf a doc law or statutes of any State.
